Terms of Service

1. Acceptance of Terms

By accessing or using https://ideatoimg.com (the "Service"), you agree to these Terms of Service ("Terms"). We may update these Terms at any time. Material changes will be announced via the Service and/or email. Continued use after changes become effective means you accept the updated Terms.

2. Eligibility

The Service is intended for users 18 years of age or older. By using the Service, you represent that you are at least 18, have full legal capacity, and that your registration information is accurate and current. If we discover or suspect that a minor is using the Service, we may suspend or terminate access and handle related data in accordance with our Privacy Policy.

3. Description of Service

ImageToImg is an AI-powered image generation and editing platform that aggregates multiple AI models and templates. The Service is provided "as is" and may not be error-free. We do not guarantee uninterrupted availability or perfect accuracy of Outputs. We may modify, suspend, or discontinue any part of the Service for maintenance, upgrades, compliance, or cost reasons.

4. User Accounts

You must provide truthful information and keep your account secure. You are responsible for all activity under your account and may not share, transfer, or sell your account. We may apply risk controls for abnormal logins, abuse, or fraud (including rate limits, temporary freezes, or termination). Accounts are for individual use only; sharing or lending accounts may result in suspension or termination.

5. Intellectual Property

Inputs

You retain ownership of text prompts and images you upload ("Inputs").

License to Platform

You grant ImageToImg a non-exclusive, worldwide, royalty-free license to host, copy, process, and display your Inputs solely to provide and improve the Service.

Outputs

Subject to your payment of applicable fees and compliance with these Terms, ImageToImg assigns to you any rights we may have in the generated images ("Outputs"). You may use Outputs for personal or commercial purposes. You acknowledge that AI systems can produce similar outputs for different users, and you do not receive exclusivity in any style or result.

6. User Conduct

You are responsible for ensuring your Inputs and use of Outputs comply with law and do not infringe third-party rights. You agree not to:

  • Submit Inputs you do not have rights to use.
  • Rely on Outputs as legally or factually accurate without independent review.
  • Generate or distribute NSFW content outside permitted areas, or any content involving minors.
  • Generate CSAM (zero tolerance), violent, hateful, or illegal content.
  • Create deepfakes or realistic images of real people (public or private) without authorization, or use such content to deceive.
  • Reverse engineer, abuse APIs, scrape data, or attempt to bypass technical limits.

We do not guarantee Outputs are unique, non-infringing, or copyrightable. You are responsible for assessing risks related to commercial use, advertising, or branding.

7. DMCA & Copyright Policy

We maintain a DMCA-compliant copyright complaint process. If you believe your copyright is infringed, please contact us at support@ideatoimg.com with sufficient information for us to review and remove the content as required by law.

8. Payment & Refunds

Payments, fees, and refunds are governed by our Refund Policy, available on the Service.

9. Indemnification

You agree to indemnify and hold ImageToImg harmless from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or lost-profit damages.
  • We are not responsible for outages or content issues caused by third-party AI models or providers.
  • Our total liability to you is limited to the amount you paid to us in the six (6) months before the claim.

11. Dispute Resolution

All disputes will be resolved by binding arbitration rather than in court, and you waive any right to participate in class or representative actions. This does not prevent either party from seeking injunctive relief for intellectual property misuse.

12. Termination

We may suspend or terminate accounts immediately for violations of these Terms, especially for illegal content generation. In such cases, any remaining fees or credits are forfeited where allowed by law.

13. Governing Law & Contact

These Terms are governed by the laws of Singapore, without regard to conflict of law principles.
